FORMAL COMPLAINT: REPORT OF PLANNING BREACHES AND REQUEST FOR STATUTORY TEMPORARY STOP NOTICE (TSN)
Reference: Planning Applications 25-0117 & 25-0176 (Conditions associated with Approval 21-0185)
Dear Head of Planning Enforcement,
I am writing to formally register a complaint regarding multiple, severe breaches of planning control at the Junction 10 HIF Scheme.
While an informal pause in activity is noted, it offers no statutory protection. Given the irreversible nature of the damage to irreplaceable habitats, I formally request the issuance of a Temporary Stop Notice (TSN) under the Levelling-up and Regeneration Act 2023 to secure a 56-day investigative window.
1. BREACH OF CONDITION 25-0117 (Arboriculture/Trees)
The following activities represent a direct breach of a "Condition Precedent" (work commenced prior to discharge) and a failure to adhere to NPPF Paragraph 186(c) regarding Irreplaceable Habitats:
Failure of Due Diligence: The Arboricultural Impact Assessment (AIA) used for the site under-calculated the Root Protection Areas (RPAs) of four Veteran/Mature oak trees (T386, T386, T391, T393) by approximately 50%.
Unauthorized Excavations: Between October 2025 and January 2026, 5-foot deep trenches were manually excavated within 2m of trunks of these trees without an approved Tree Protection Plan (TPP) or BS5837:2012 compliance.
Failure to Protect: Root structures were left exposed to pathogens and water ingress. Subsequent backfilling used unspecified "foreign matter" rather than approved soil, creating a high risk of long-term decay.
Fencing Violations: Protective fencing was either non-existent during excavations or incorrectly placed, even now failing to cover even 50% of the corrected RPAs required for Veteran tree survival.
Habitat Loss: Unauthorized removal of important hedgerow (AIA H394) from within the RPAs of three Veteran trees thus affecting their integrity.
2. BREACH OF CONDITION 25-0176 (Landscaping)
This condition remains undischarged, yet the following unauthorized works have occurred:
Premature Commencement: Multiple landscaping activities have been enacted without discharge of the subject condition.
Unauthorized Woodland Removal: A large area of woodland designated for retention under approval 21-0185 (Annex F/G) has been removed without authority or formal record.
Material Discrepancy: Information provided on SCC A320 commonplace website reveals a revised plan that contradicts the original approval documents, suggesting an attempt to bypass formal scrutiny of further woodland habitat loss.
FORMAL REQUEST FOR ACTION
I consider the current development status unlawful due to the breach of pre-commencement conditions. I formally request that the Council:
Issue a 56-day Temporary Stop Notice (TSN) to prevent further irreparable harm to irreplaceable veteran trees and woodland.
Register this as an objection against each condition and provide the name of the assigned Enforcement Officer.
Mandate a full Arboricultural Audit to assess the damage to T386, T388, T391, and T393.
Involve the ONF as a Statutory Consultee on my behalf for the duration of the investigation.
